Terms of Service & Liability Waiver

**PLEASE READ CAREFULLY.**
By accessing this website or participating in any online coaching, virtual classes, in-person Zumba classes, personal training sessions, or related services provided by **[Joyful Unicorn Fitness** (“Dancing Unicorn Queen LLC,” “we,” “us,” or “our”), you agree to the terms below. This agreement includes a **release of liability** and affects your legal rights.

 

Voluntary Participation & Assumption of Risk

The Company provides **online fitness coaching, virtual instruction, in-person group fitness classes (including Zumba), and on-site personal training services** (collectively, the “Services”). These Services may take place **online, in studios, outdoors, at private or third-party locations, or at a client’s home or workplace**.

I understand that fitness and exercise activities involve **physical movement and exertion** and carry inherent risks, including but not limited to:

* Muscle strains, sprains, or soreness
* Slips, falls, or collisions
* Injury from equipment or flooring
* Illness or exposure to communicable diseases (including COVID-19 or similar illnesses)
* Permanent injury, disability, or death

I voluntarily choose to participate with full knowledge of these risks. I understand that injuries or losses may occur **even when instructions are followed and reasonable care is taken**. I knowingly and freely **assume all risks**, whether known or unknown, related to my participation.

Online & Remote Training Risks

I understand that **online and virtual fitness coaching** may involve limited ability for the instructor to see, correct, or supervise my movements. I accept full responsibility for:

* My exercise environment (space, flooring, equipment, internet connection)
* Performing movements safely and within my personal limits
* Modifying or stopping exercises as needed

I understand that the Company cannot monitor my physical condition during online sessions and is not responsible for injuries that occur during virtual participation.

Health & Medical Responsibility

I confirm that I am physically and mentally capable of participating in the Services. I understand that:

* I should consult a physician before beginning any fitness program
* I am responsible for knowing my own limitations
* I should stop immediately if I feel pain, dizziness, or discomfort

If I am registering or participating on behalf of a **minor**, I accept full responsibility for that minor’s participation and safety.

Release of Liability (California)

To the fullest extent permitted by **California law**, I agree to **waive, release, and forever discharge** **Joyful Unicorn Fitness**, including its owners, instructors, employees, independent contractors, agents, volunteers, and affiliates (collectively, the “Released Parties”), from **any and all claims or legal responsibility** related to my participation in the Services.

This release includes claims arising from:

* Personal injury, illness, disability, or death
* Participation in Zumba or other group fitness classes
* Personal training sessions at any location
* Online or recorded coaching content
* Use or misuse of equipment
* First aid or medical assistance
* Theft, loss, or damage of personal property
* Travel to or from any in-person session

I understand and agree that this release applies **even if the injury or loss was caused by the negligence of the Released Parties**, except where such a waiver is not allowed under California law.

California Civil Code §1542 Waiver

I understand that California law states:

*“A general release does not extend to claims that the releasing party does not know or suspect to exist at the time of executing the release.”*

I **knowingly and expressly waive** any rights under **California Civil Code Section 1542**, meaning I release claims I may not yet know about.

No Lawsuits & Indemnification

I agree not to file or assist in any lawsuit or claim against the Released Parties for matters covered by this agreement.

I further agree to **defend, indemnify, and hold harmless** the Released Parties from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from:

* My participation in the Services
* My actions during sessions
* Claims brought by others on my behalf

Global Participants

If I access or participate in the Services from outside the United States, I understand that:

* I am voluntarily agreeing to these terms under **California law**
* I am responsible for following local laws and regulations in my country
* Any dispute will be governed by California law, regardless of my location

Term & Revocation

This waiver applies to all current and future participation unless I revoke it **in writing**, and the Company **confirms receipt in writing**. Any revocation does not apply to past participation.

Governing Law & Venue

This agreement is governed by the laws of the **State of California**. Any legal action must be brought in a state or federal court located in **California**.
